Tackling issues of Laws on Enterprises and Investment

VTV.vn - Prime Minister Nguyen Xuan Phuc presided over the first meeting on Monday in Hanoi with ministerial and sectoral leaders seeking to remove obstacles arising in the enforcement of the Laws on Enterprises and Investment.

In the meeting, the prime minister underlined all government decrees must be issued before May 30 as part of efforts to speed up the implementing guidelines of the legislation.

According to Prime Minister Nguyễn Xuân Phúc, the Law on Enterprises and the Law on Investment both took effect on July 1 last year. However, many difficulties in implementing these two laws still need resolving, especially differences in their policies.

According to the Ministry of Planning and Investment, the mismatch between the Law of Investment and other laws mainly lies in the environmental impact assessment procedure, which is actually specified in the Law on Environmental Protection.

Currently, there are 114 legal documents that set out the requirements for 267 different occupations and business sectors that were issued by various ministries, but under the new Law on Investment, they will become invalid on July 1. The government must issue new regulations to replace them as ministries will no longer have the authority to regulate this area.

Currently, 45 provinces and 14 ministries still haven’t completed the process of reviewing and collecting the business and investment conditions they issue. If the government does not issue necessary documents on business and investment conditions, there will be a legal void.

The prime minister also mentioned the situation in which businesses are compelled to pay bribe money to complete basic procedures such as receiving land use rights certificates.

The prime minister therefore underlined the importance of tackling the issues arising from the Law on Enterprises and the Law on Investment and their impact on the public.

There should be high political determination in order to tackle the outstanding issues that haven’t been resolved involving these pieces of legislation. The implementation of the two laws is attached to the reinforcement of Decree 19, which aims at creating the most favourable conditions for the people as well as businesses. Therefore, it is important to be aware of this common interest and not to shirk responsibilities.

In order to resolve the problem, the prime minister has ordered ministries to submit their reports to the government in order to accelerate the implementation of the two laws. He also assigned the head of the Government Office to directly supervise the process of drafting decrees replacing the entire circulars and decisions issued by the ministries and localities concerning necessary business and investment conditions.
